Terms and conditions
Once you have completed and signed your electronic contract with Jo Temple Photography you will be agreeing to the following terms and conditions.
The 1988 Copyright Act assigns copyright to Jo Temple Photography. The copyright and ownership of all images under the terms of this booking remain with Jo Temple Photography. The client shall have no right to reproduce, nor to authorise the reproduction of any photographs created by Jo Temple Photography unless Jo Temple Photography grants specific permission. All original digital/negative files remain the property of Jo Temple Photography. The client hereby gives permission for Jo Temple Photography to display any images captured under the terms of this agreement for the purpose of promoting Jo Temple Photography, such as, but not limited to brochures, display prints, advertising in any form or website display, providing that the images are used lawfully and without damage to the client.
Exclusive printing rights
Should the client purchase all of their digital images from their gallery the client will be given exclusive printing rights to these images. The client will be able to print unlimited prints of their images, share on social media sites and keep their digital files forever. Printing, copying, altering or displaying any of these files for commercial gain is strictly prohibited.
Payment/securing your booking
Along with your online contract; the session fee/deposit is required upfront to secure your booking. Bookings will be held provisionally for 5 days at the time of booking. Payments for the session fees can be made directly via
1. Bank transfer
2. Cheque, made payable to “Jo Temple Photography Ltd”
In the event of less than 48 hours cancellation notice the deposit or session fee is non refundable. If the date is postponed and 48 hours notice given then all monies paid to date can be carried forward and applied to the new booking. If less than 48 hours notice is given and client wants to postpone it will be deemed as a late cancelation and the deposit/session fee will be non refundable.
In the unlikely event, should sudden illness or any other unforeseen incident prevent a Jo Temple from attending your session, Jo Temple Photography will endeavour to rearrange an alternative date. If this is not possible Jo Temple Photography will only be liable to reimburse all monies paid to date. Jo Temple Photography will make every effort to assure your satisfaction according to accepted industry standards. However, due to events outside of the photographers control, such as, but not limited to, weather, venue restrictions or short timelines, the production of any specific images cannot be guaranteed. Although Jo Temple Photography will exercise all reasonable care and diligence in the discharge of their duties, it is understood that, in the event of any unforeseen circumstances causing loss of all photographic record, Jo Temple Photography will only be responsible for the return of the money paid to date. If the client has already been delivered the products and prints from an order placed prior and or after the session and the archive is lost subsequently, Jo Temple Photography will have been seen to have completed their duties according to this contract and will not be liable under any circumstances to replace the photographic record.
Please only bring people that will be photographed to the session. Also please do not being any camcorders, cameras or recording devices to your session.
Most orders will be turned around within 4 to 6 weeks from your initial gallery viewing and order placement. However some orders may take longer to complete due to additional editing time needed or external companies stock and ability to supply. If your order is urgent please ensure that you stress this to Jo Temple Photography at the time of placing the order and Jo Temple Photography will endeavour to satisfy your specific requirements and keep you fully informed as to order progress. Any prints you order directly from Jo Temple Photography’s website are fulfilled though a reputable vendor company. Session fees and digital copies of images are fulfilled directly through Jo Temple Photography.
There is a minimum spend of £250.00 per order.
Your album will be available to view within 3 - 4 weeks of your session via this page on Jo Temple Photography website http://www.jotemplephotography.co.uk/clients.html. You will be given an access code. Your images shall remain visible for your family and friends to view online for a minimum period of 5 days. Jo Temple Photography keeps all digital files for 6 months to give the client plenty of time to purchase. After the period of 6 months has passed and the client has not purchased the images, the client will be given a weeks notice, after which the clients digital images will be archived. There is a £75.00 fee to retrieve the files from archive.
All session fees are based on maximum of 1 - 2 children and maximum 2 adults. Any extra persons, whether adult or child, will be charged an additional £50.00 per person whether adult or child.
Travel within a 30 mile radius of Camberley will be included within the agreed price, this covers most of Surrey, Hampshire and Bershire. Should a job require travel outside this 30 mile radius this will be discussed, quoted and agreed upon at the time of booking and the agreed budget shall not be exceeded without prior consultation with the client.
All clothing must be ironed prior to the shoot. Creases DO show up in photos. The retouching involved in un-ironed, creased clothing is extensive and will incur an extra fee.
Face blemishes, bruises, cuts and scrapes
Anything such as bruises, cuts and scrapes will be edited out in a clients final gallery photographs. Any permanant facial blemishes, scars, moles etc will not unless Jo Temple Photoghraphy is told by the client on their signed contract form.
Snotty noses and food on face
It is parents responsibilities to ensure children's noses and faces are clean throughout the session. A photograph of a child with a heavy cold can take double the time to edit. An additional editing fee may be incurred if a childs face or nose are particulary messy.
Jo Temple Photography has a distinctive style and the final edited photographic collection may be delivered in a mixture of black and white, as well as colour images. The selection of which images are black and white will be at the discretion of Jo Temple Photography during the post production process. Any editing will only be carried out to enhance the quality and reproduction of the image. Colour photography is undertaken within the technical limitations of the process and certain colours may not necessarily be the facsimile over the whole range of colours within the subject. Prints made at different times may vary in colour balance. It is understood that, due to the technical limitations of the printing process, the colour reproduction of prints cannot be guaranteed to be identical to those viewed at the proofing stage. Jo Temple's style of photography often includes very close up portraits of her subjects. This involves tops of heads, sometimes even ears left out of the picture. Should the client not want close up photographs such as this, it must be made clear to Jo Temple in writing before the photoshoot takes place.
Postage and Packing
Should you order any frames or framed collections from your session, these will be hand delivered to you if you live within the 30 mile radius of Cambereley. Should you live outdie this radius the postage and packaging fee will be added to your invoice. USB Flash drives purchased on their own will be posted via recorded delivery at no extra charge. Please note that Jo Temple Photography cannot be responsible for any breakages during postage transit and asks that anything deemed breakable is collected. All products will be sent to you in perfect condition.
Product Return Policy
Due to the bespoke nature of the products, returns will only be accepted if the product is faulty. If for any reason you are not satisfied with a print or product order we will refund your order upon its return to us in the condition that it was received. Return shipping charges are your responsibility. You must contact us prior to any return and we will issue specific instructions. If your order is delivered damaged it is your responsibility to contact the company that handled the delivery and please save all packing materials. Failure to do so can cause the shipper to deny your claim. Shipping fees are not refundable.
Jo Temple recommends that you (1) use a carrier that offers shipment tracking for all returns and (2) either insure your package for safe return to Jo Temple Photography or declare the full value of the shipment so that you are completely protected if the shipment is lost or damaged in transit. If you choose not to (1) use a carrier that offers tracking or (2) insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping.
If for any reason after receiving your confirmation, you fail to attend your photo shoot appointment, the session fee will be kept by Jo Temple Photography and should you wish to book again the sessson fee must be paid in full again.
Jo Temple Photography shall not use your email address for any purpose other than communications about your photo shoot and images or to advise you of products, services and special promotions. Jo Temple Photography may contact you by post, telephone, SMS text or email. But we will not sell or pass on your email address to anyone else. Your online images can only be seen by logging on to www.jotemplephotography.co.uk going to the GALLERY tab and clicking "client access" Jo Temple Photography will issue you with a client access code, but we will not be held responsible for any hacking or other activity that bypasses this process.
The client should raise any complaints with Jo Temple Photography in writing or email within 14 days of the client’s images being received. After this time the complaint will be deemed as invalid.
Changes to terms and conditionsOur mission is to provide a quality service to our clients. In order to do so we must reserve the right to change our terms and conditions without notice at any time. If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
